INDECENT ASSAULT, INCEST AND ADULTERY
INCEST
- act of sexual intercourse by a man with a woman within a certain degree of blood relationship.
- prohibited in most of the countries but not in India.
- for example, a daughter, granddaughter, sister, stepsister, aunt, or mother.
- Instances between father and daughter and brothers and sister are common.
- When anyone enters into an incestuous relationship willingly, it is not an offence.
INDECENT ASSAULT:
- means sex-linked misbehavior towards a person of opposite sex or same sex.
- To get sexual gratification.
- The offence is punishable under Sections 351 and 354 of IPC, upto 2 years imprisonment and/or fine.
- Protection of Women Against Sexual Harassment at Workplace Bill 2010 was passed.
ADULTERY:
- Adultery refers to volutary sexual intercourse between a married person and a person (married or not), other than his/her spouse.
- Section 497 of the Indian Penal Code was a section dealing with adultery.
- Under this law a woman cannot be punished for the offence of adultery but man can be punished under this offence in India.
- If someone “lives in adultery”, the partner can file for divorce. The law became defunct on 27 September 2018 by Supreme Court of India
