Introduction:

sexual offences: Defined  as unlawful (illegal) sexual  intercourse  with  a second  person

(man/woman) or  animal to obtain  sexual  gratification. 

Sexual  offences  may be :-

1) Natural  sexual  offences:

  • Refers  to  sexual offences  involving  the  use of sex  organs in  natural way’ i.e.  penis  and vagina  are  involved’. 
  • Natural  sexual offences  are  rape, adultery and  incest”

2) Unnatural  sexual  offences  :

  • Refers  to  sexual  offences involving  the  use  of sex organs  against  the  law  of nature’  e.g  sexual intercourse through anus,  mouth  or animals’ They  are  a  crime’  even               when done  with consent.
  • Unnatural  sexual  offences  are  sodomy, lesbianism (tribadism),  buccal  coitus,and bestiality.
  • sexual  perversions  are  acts  intended  to  result  in  sexual  gratification  without sexual intercourse.
  • Sexual harassment: punishable with (rigorous) imprisonment for 1-3 years with/without fine (Sec.354-A IPC), the offence is cognizable and bailable.
  • date rape drugs are rohypnol and ketamine that facilitates rape.

Other drugs 

  • Hypnotics such as zopiclone or the widely available zolpidem (Ambien), 
  • Sedatives such as neuroleptics (anti-psychotics), chloral hydrate or some histamine H1 antagonists, 
  • Commonly recreational drugs such as ethanol, marijuana, cocaine, and 
  • Less common anticholinergics, barbiturates, opioids, PCP, scopolamine,nasal spray ingredient oxymetazoline,and certain solvents like Gamma-hydroxybutyrate. 

Rape:

  • Rape (Latin rapere: to seize or take by force)  ia an unlawful sexual intercourse by a man with woman, and is defined under Sec. 375 IPC.
  • After 3 february  2013, age to  define  rape  has been changed.
  • The 2013 law also increased the age of consent from 16 years to 18 years, and any sexual activity with anyone less than age of 18, irrespective of consent, now constitutes statutory rape.
  • On 3 November 2015 the Allahabad High Court observed that a child born out of rape will have inheritance rights over the property of the assaulter and will be treated as illegitimate.
  • Whoever, except in the cases provided for by sub-section, commits rape shall be punished with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years and shall also be liable to fine unless the women raped is his own wife and is NOT  under twelve years of age.

As introduced in lok sabha (Bill no-126 of 2018):- 

  • Sec “376AB. whoever, commits rape on a woman under twelve years of age shall be punished with rigorous imprisonment for a term which shall not be less than twenty years 
  • This may extend to imprisonment for life, which shall mean imprisonment for the remainder of that person’s natural life, and  WITH FINE OR WITH DEATH.
  • section 376(DA)– Gang rape of female
  • section 376(DB)– Gang rape of female.
