INDECENT ASSAULT, INCEST AND ADULTERY

INCEST

  • act of sexual intercourse by a man with a woman within a certain degree of blood relationship.
  • prohibited in most of the countries but not in India.
  • for  example,  a daughter,  granddaughter, sister,  stepsister, aunt,  or mother.
  • Instances between  father  and  daughter and  brothers  and  sister  are  common.
  • When anyone enters into an incestuous relationship willingly, it is not an offence. 

INDECENT ASSAULT:

  • means sex-linked misbehavior towards a person of opposite sex or same sex.
  • To get sexual gratification.
  • The offence is punishable under Sections 351 and 354 of IPC, upto  2 years  imprisonment  and/or  fine.
  • Protection of Women Against Sexual Harassment at Workplace Bill 2010 was passed.

 ADULTERY:

  • Adultery  refers to  volutary  sexual  intercourse  between  a married  person  and  a person  (married  or not), other than  his/her  spouse.
  • Section 497 of the Indian Penal Code was a section dealing with adultery.
  • Under this law a woman cannot be punished for the offence of adultery but man can be punished under this offence in India.
  • If someone “lives in adultery”, the partner can file for divorce. The law became defunct on 27 September 2018 by Supreme Court of India
