• Whoever, except in the cases provided for by sub-section (2), commits rape shall be punished with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years and shall also be liable to fine unless the women raped is his own wife and is NOT  under twelve years of age.

As introduced in lok sabha(Bill no-126 of 2018):- 

• Sec “376AB. Whoever, commits rape on a woman under twelve years of age shall be punished with rigorous imprisonment for a term which shall not be less than twentyyears 
• But which may extend to imprisonment for life, which shall mean imprisonment for the remainder of that person’s natural life, and WITH FINE OR WITH DEATH.

Date Rape Drug

Any drug (either surreptitiously or openly administered) that facilitates rape could be considered a date rape drug.

The drug most commonly used to facilitate sexual assault is alcohol, consumed voluntarily.

Newer date rape drugs are rohypnol and ketamine.

Other drugs

1. Hypnotics such as zopiclone or the widely available zolpidem (Ambien),
2. Sedatives such as neuroleptics (anti-psychotics), chloral hydrate or some histamine H1 antagonists,
3. Commonly recreational drugs such as ethanol, marijuana, cocaine, and
4. Less common anticholinergics, barbiturates, opioids, PCP, scopolamine,nasal spray ingredient oxymetazoline,and certain solvents like Gamma-hydroxybutyrate.

Glaister Keene Rods

Glaister Keene Rods may be used to determine degree of rupture of hymen and whether the rupture is recent or old. These rods are bent at 150 degrees at one end.

i) These are used for close examination of the hymen.

ii) These are glass or plastic rods with a diameter of 5 mm having a globe at one end and varying in size from one to two and half cm.

iii) The rod is warmed to body temperature and passed through the hymental orifice, spherical head first.

iv) Then it is passed round the posterior surface of hymen, which is slightly stretched by separation of labia minora. In this way, the edges of the hymen become slightly everted. By slowtly rotating the sphere around the edges, natural notches are easily differentiated from tears, recent or old.

v) This method does not cause pain or injury.

Statutory rape is sexual intercourse with a women below the age required/to legally consent the act, i.e. a girl below 16 years (if not wife) and below 15 years (if wife).

Rape

• According to Section 375 IPC, a man is said to commit rape, if he has sexual intercourse with a women :‑

1. Against her will
2. Without her consent
3. With her consent if she is

• Less than 16 years of age.
• With his own wife less than 15 years of age.
• Intoxicated or has unsound mind so that she is unable to understand the conseqences.
• Consent is obtained by unlawful means, i.e. fears of death or hurt to herself or to some one whom she is interested.
• Impersonation , i.e. when the man knows he is not her husband and her consent is given because she believes that he is another man to whom she is lawfully married.
